TERMS AND CONDITIONS OF SALE

The Embassy of the United States of America in Bogota, Colombia is selling goods, furniture, and surplus through an Electronic Auction on the Web. Each auction will be activated for a period that clearly indicates the start and end date. This information is available in the information panel of the web application. Usually, it will be active for a week. During this period, you can actively participate and bid on the surplus property. The maximum number of offers in a lot is indicated in each of these. Increasing your bids is only possible in the name of the local currency (COLOMBIAN PESOS). During the auction, you must monitor your bids so that you can react to the price development of all bids.

1) The virtual sale will be enabled from August 14 to August 16, 2025.

2) To avoid claims, buyers are reminded that the exhibition conforms to what is described in the sales catalog, and all personal property is sold as a true body.

3) The Embassy of the United States of America reserves the right of admission to the virtual platform.

4) To participate in the sale:

a) The bidding buyer must register on the electronic platform (the buyer is responsible for the veracity and for verifying that their registered information is correct).

b) If you want to make the offer on behalf of a business or company, you must register as such and present the documentation that accredits you as responsible for making the offer.

c) The system will not allow you to make corrections or modify the offers after the virtual sale has closed on the portal.

d) The platform is available and accessible from any Smartphone, laptop, tablet, computer, etc.

5) Award of Lots:

- The lots will be awarded to the highest bids received; the favored bidders will be notified by e-mail or telephone, within the following days after the sale has been closed.

- The total payment of the awarded lots must be made only through electronic transfer from your bank account through the Itaú and PSE banking platform from August 21 to August 23, 2025, after receiving the award notification.

- To withdraw the awarded lot or lots, you must present the original and one (1) copy of your identification document, cedula and/or the respective certificate of constitution and management.

- In the event that the buyer does not accept the lot or lots awarded to him; if there are two or more and you wish to pay or partially withdraw, it will not be possible, since when they are awarded you must pay and withdraw all of these or you will be sanctioned and will not be eligible to participate in future sales with the Embassy of the United States.

- Reassignment of lots: if the payment of the lots awarded has not been made on the established dates or the lots that are awarded are not accepted, they will be assigned to the next bidder on the list, and they will be notified the following days. at the close of the sale.

- For reassignments, the same conditions of the first successful bidders apply.

- Officials of the Embassy of the United States will communicate by means of official email or telephone with the buyer (only a call will be made to the registered numbers) indicating the value to cancel and the method of payment. It is the responsibility of the bidding buyer to be attentive to the communications that will be made.

6) The deliveries of the lots will be made from August 25 to August 27, 2025, or by assignment according to the number of lots awarded, from 9:00 a.m. to 12:00 p.m. and from 1:00 p.m. at 4:00 p.m. at Av. Calle 22 No 68b-75 Bodega Zona Industrial (Av. Ferrocarril de Occidente) Montevideo Warehouse, Bogota-Colombia, the buyer must present the receipt of the transaction, the Embassy will issue a document or act of adjudication for its lot. Lots that are in locations other than the warehouse must be collected in accordance with the regulations and schedule that will be previously notified to the successful bidder.

7) If after the date of withdrawal of lots, the successful bidder has not withdrawn the lot, or lots, must pay the expenses for storage to the Embassy of the United States of America, without exceptions, which will be $ 100,000 pesos COL. for each batch stored per day; A receipt will be generated for this concept which must be canceled at the embassy facilities before withdrawing the lot.

8) In the case of vehicles or parts that are sold as scrap, it is not allowed to register or register them before any customs or government entity and the Embassy of the United States is not responsible for inconveniences caused by non-compliance with this agreement.

9) Persons who, due to a force majeure reason, cannot collect their award records or personally withdraw the lots, must send a written authorization authenticated by the awardee's notary, with a copy of the identification documents of the awardee as the authorized person.

10) After removing the lots from the facilities where they are located, no type of claim is accepted. All movable property is sold as a “cuerpo cierto”.

11) At the time of delivery of awarded lots, buyers must present their award certificates, bring the vehicle and personnel to load the lots that were awarded; Personnel who are going to enter to pick up batches must carry their identification document (card) and register in advance, the embassy staff is not authorized to load, nor is it responsible for loading the vehicles The successful bidder is responsible for the handling of the acquired movable property or the machinery required for this purpose.

12) The elements offered for sale are delivered on the site and in a state of conservation as they have been exhibited and observed, no claims or returns are accepted for being in poor condition, broken, without parts. The Embassy does not offer any type of guarantee on the items sold. All movable property is sold as a certain body.

13) The Embassy of the United States of America reserves the right to withdraw any lot or item offered for sale at any time before it is awarded and to reject any kind of offer or treatment that is against the interests of this mission.

14) Any capable natural and/or legal person, national or foreign, of legal age, duly identified, as well as on behalf of legal persons, their duly accredited representatives, or their authorized delegates through written communication and cedula, presenting the respective certificate of incorporation and management.

15) Tax Liability Disclaimer Clause: “The U.S. Embassy shall not be held liable for any taxes, duties, or fees that may be incurred by the purchaser because of this transaction. The purchaser is solely responsible for complying with all Colombian applicable tax obligations under the laws and regulations, including but not limited to registration fees, value-added tax (VAT), capital gains tax, or any other local levies arising from the acquisition of the property.”

16) They will not be able to participate in this type of event, the natural and/or legal person that has been sanctioned in previous sales, nor those that are included in the Clinton list (OFAC) or belong to any group, association, company that are against the interests of the mission or carry out actions that are not within the law.

DEED OF COMMITMENT AND CONDITIONS OF SALE FOR VEHICLES WITH YELLOW PLATES

EMBASSY OF THE UNITED STATES OF AMERICA

The Embassy requires that the process be completed in the name of the successful bidder. THERE ARE NO EXCEPTIONS.

1. The vehicle will be awarded the highest bid received and will be notified by email or phone within the week following the sale.

2. The successful bidder must pay using the method stipulated by the Embassy for this sale. The successful bidder will be contacted and must be present no later than August 27, 2025, to sign the necessary documentation and receive the deed of award to begin the transfer process.

Additionally, for transfer purposes, the buyer must provide the address of the successful bidder and submit their identification document: Colombian Citizenship Card, Foreigner's Identification Card, Passport, or RUT (Tax ID) if the transfer is in the name of a legal entity.

NOTE: The buyer must be registered with the RUNT (National Single Transit Registry).

3. For vehicles with yellow license plates, the embassy will request the One-Stop Shop to upload the vehicle information to the RUNT platform and pre-assign the license plate. The embassy will then email the successful bidder the transfer note and the import documents. Once the One-Stop Shop confirms the pre-assigned license plate number, the successful bidder must complete the vehicle registration within a maximum of one month. The successful bidder must assume the costs inherent to this process.

4. The Embassy reserves the right to refuse authorization to sell the vehicle(s) previously awarded to the interested party for reasons that cannot be explained in this document. The client accepts the return of the deposited amount(s), without any compensation from the U.S. Embassy.

5. The auctioned vehicle will remain on the Embassy premises and will not incur any storage fees as long as the successful bidder completes the procedures within the timeframe stipulated in sections 2, 5, and 9 of this Agreement. However, if the successful bidder experiences delays due to negligence caused by the failure to submit or delay in submitting documentation and/or failure to appear in person for the signing of the award certificate, this will result in the daily storage costs stipulated in the award certificate. When storage costs equal to or greater than the cost paid by the successful bidder at the time of the vehicle assignment, the embassy will use the vehicle as payment for the storage costs incurred.

6. The Embassy of the United States of America will under no circumstances recognize interest or compensation for damages suffered by the successful bidder, for any delay in processing the transfer documents for the vehicle(s) and/or motorcycle(s), or for any other reason.

7. Consequently, the Embassy of the United States of America will not be liable for damages suffered, whether consequential or lost profits, arising directly or indirectly from the events referred to in this document.

8. The successful bidder must receive the vehicle in its current physical and mechanical condition and in the state of preservation as observed on the day of the auction.

9. Once the vehicle is registered, the successful bidder must submit a legible copy of the vehicle ownership card to the Embassy within 30 business days of receiving the documentation to begin the process. Once the successful bidder submits a legible copy of the vehicle ownership card to the Embassy, the delivery of the vehicle to the successful bidder will be coordinated.

10. The successful bidder may not offer or promise to sell the vehicle(s) purchased at this auction before completing the transfer to their name and submitting a copy of the vehicle ownership card to the Embassy.

11. Vehicles purchased through this sale must be registered solely as a private service.

12. Anyone purchasing a lot does so in a personal capacity, and outsourcing the process is not acceptable until the vehicle is delivered (once the successful bidder has already registered the vehicle in their name).

13. In the event of the death of the successful bidder, the procedure will be followed in accordance with current legal regulations.

The successful bidder declares that he or she is aware of and accepts the conditions stipulated in this document for the auction(s) of the Embassy of the United States of America and that he or she agrees to them as a condition of participation in them, and that he or she waives any claim due to ignorance or misinterpretation of any of the terms included in this document.

Lots that are in locations other than Diagonal 22A # 68B-75/81 Warehouse, Bogota-Colombia must be collected in accordance with the regulations and schedule that will be previously notified to the successful bidder.

If after the date of withdrawal of lots, the successful bidder has not removed the lot, or lots, he must pay the storage expenses to the Embassy of the United States of America, without exceptions, which will be $100,000 pesos COL., for each batch stored per day; A receipt will be generated for this concept which must be paid at the embassy facilities before picking up the lot.
